Delivery and Returns

 

CONSUMER RIGHTS – WITHDRAWAL – CANCELLATION AND RETURN CONDITIONS

 

GENERAL:

  1. If you place an order electronically through the website you are using, you are deemed to have accepted the pre-information form and the distance sales agreement presented to you.

  2. Buyers are subject to the provisions of Law No. 6502 on Consumer Protection and the Regulation on Distance Contracts (Official Gazette: 27.11.2014/29188) and other applicable laws regarding the sale and delivery of the product they purchase.

  3. Shipping fees, which are product shipment costs, will be paid by the buyers.

  4. Each purchased product is delivered to the person and/or organization at the address indicated by the buyer, provided that it does not exceed the legal period of 30 days. If the product is not delivered within this period, the Buyers may terminate the contract.

  5. The purchased product must be delivered complete, in accordance with the specifications stated in the order, and with a warranty certificate, user manual, and other documents if any.

  6. If the sale of the purchased product becomes impossible, the seller is obliged to notify the buyer in writing within 3 days from the date of learning of this situation. The total amount must also be refunded to the Buyer within 14 days.

 

IF THE PURCHASED PRODUCT PRICE IS NOT PAID:

  1. If the Buyer does not pay the price of the product he/she purchased or cancels it in the bank records, the Seller's obligation to deliver the product ceases.

 

PURCHASES MADE WITH UNAUTHORIZED USE OF CREDIT CARD:

  1. If it is determined that the credit card used by the buyer for payment was unlawfully used by unauthorized persons after the product is delivered, and the product price is not paid to the Seller by the relevant bank or financial institution, the Buyer must return the product subject to the contract to the SELLER within 3 days, with shipping costs belonging to the SELLER.

 

IF THE PRODUCT CANNOT BE DELIVERED ON TIME DUE TO UNFORESEEN REASONS:

  1. If unforeseen force majeure events occur for the Seller and the product cannot be delivered on time, the Buyer is informed of the situation. The Buyer may request the cancellation of the order, replacement of the product with a similar one, or postponement of the delivery until the obstacle is removed. If the Buyer cancels the order; if the payment was made in cash, this fee is paid back to him in cash within 14 days from the cancellation. If the Buyer made the payment by credit card and cancels it, the product price is returned to the bank within 14 days from this cancellation, however, the bank may transfer it to the buyer's account within 2-3 weeks.

 

BUYER'S OBLIGATION TO INSPECT THE PRODUCT:

  1. The Buyer will inspect the goods/services subject to the contract before receiving them; dented, broken, torn packaging, etc. He/she will not receive damaged and defective goods/services from the cargo company. The received goods/services will be deemed to be undamaged and sound. THE BUYER is obliged to carefully protect the goods/services after delivery. If the right of withdrawal is to be used, the goods/services should not be used. The invoice must also be returned with the product.

 

RIGHT OF WITHDRAWAL:

  1. THE BUYER may exercise his/her right of withdrawal from the contract by rejecting the goods without undertaking any legal or criminal responsibility and without showing any reason, provided that he/she notifies the SELLER via the contact information below, within 14 (fourteen) days from the date of delivery of the purchased product to him/her or to the person/organization at the address he/she indicated.

1.2 BUYER:

 

DURATION OF THE RIGHT OF WITHDRAWAL:

  1. If the purchased item is a service, this 14-day period starts from the date of signing the contract. The right of withdrawal cannot be exercised for service contracts where the performance of the service has started with the consumer's approval before the end of the withdrawal period.

  2. The costs arising from the use of the right of withdrawal belong to the SELLER.

  3. For the exercise of the right of withdrawal, a written notification must be sent to the SELLER by registered mail, fax or e-mail within 14 (fourteen) days, and the product must not have been used within the framework of the "Products for which the Right of Withdrawal Cannot Be Exercised" provisions regulated in this contract.

 

EXERCISE OF THE RIGHT OF WITHDRAWAL: 

  1. The invoice of the product delivered to the 3rd party or the BUYER, (If the invoice of the product to be returned is corporate, it must be sent with the return invoice issued by the institution when returning. Order returns for which invoices are issued to institutions cannot be completed unless a RETURN INVOICE is issued.)

  2. The return form, the box, packaging, and standard accessories, if any, of the products to be returned must be delivered complete and undamaged.

 

RETURN CONDITIONS:

  1. The SELLER is obliged to return the total amount and the documents that put the BUYER under debt to the BUYER within a maximum of 10 days from the date of receipt of the withdrawal notification and to take back the goods within 20 days.

  2. If there is a decrease in the value of the goods due to a fault of the BUYER or if the return becomes impossible, the BUYER is obliged to compensate the SELLER for his damages in proportion to his fault. However, the BUYER is not responsible for changes and deterioration that occur due to the proper use of the goods or product within the withdrawal period. 

  3. If the campaign limit amount organized by the SELLER falls below the limit due to the exercise of the right of withdrawal, the discount amount benefited from the campaign will be canceled.

 

PRODUCTS FOR WHICH THE RIGHT OF WITHDRAWAL CANNOT BE EXERCISED:

  1. Products prepared in line with the BUYER's request or explicit personal needs and not suitable for return, underwear bottoms, swimwear and bikini bottoms, make-up materials, disposable products, products that are likely to spoil quickly or expire, products that are not suitable for return for health and hygiene reasons if their packaging is opened by the BUYER after delivery, products that mix with other products after delivery and cannot be separated due to their nature, goods related to periodic publications such as newspapers and magazines, excluding those provided under subscription contracts, services performed instantly in electronic environment or intangible goods delivered instantly to the consumer, and the return of audio or video recordings, books, digital content, software programs, data recording and data storage devices, computer consumables, if their packaging is opened by the BUYER, is not possible according to the Regulation. In addition, the exercise of the right of withdrawal for services whose performance has started with the consumer's approval before the end of the withdrawal period is not possible according to the Regulation.

  2. For cosmetic and personal care products, underwear products, swimwear, bikinis, books, copyable software and programs, DVD, VCD, CD and cassettes, and stationery consumables (toner, cartridge, ribbon, etc.) to be returned, their packaging must be unopened, untried, undamaged and unused.

 

DEFAULT AND LEGAL CONSEQUENCES

  1. If the BUYER defaults when making payments by credit card, he/she accepts, declares and undertakes that he/she will pay interest within the framework of the credit card agreement with the cardholder bank and will be responsible to the bank. In this case, the relevant bank may resort to legal remedies; it may claim the expenses and attorney's fees from the BUYER and in any case, if the BUYER defaults on his/her debt, the BUYER accepts that he/she will pay the damage and loss incurred by the SELLER due to the delayed performance of the debt.

  1. You can make a Bank Transfer or EFT (Electronic Fund Transfer) to any of our İşbank accounts (TL).

  2. You can benefit from online single payment or online installment options for all your credit cards through our site. For your online payments, the amount will be charged from your credit card at the end of your order.
